Plaintiff did not assault Reyes. Mr. Reyes described the assailant as \"short,\" \"close cut\" hair, 6'2\" tall, weighed 190 pounds, and did not have an accent. Plaintiff is 5'9\", weighs approximately 150-160 pounds, has long dreadlocks, and has an accent. When shown a picture of Plaintiff, Mr. Reyes said he \"looks like the person who cut him without the hair.\" Detective Godino showed Mr. Reyes surveillance video of the attack and improperly suggested to him that Plaintiff was the assailant. On March 1, 2024, Plaintiff was arrested. The charges against Plaintiff remained pending for two and a half years. As a result of the false charges, Plaintiff and his wife's adoption of a child was put on hold. On September 15, 2016, the first day of Plaintiff's trial, Mr. Reyes observed Plaintiff and told the ADA that Plaintiff was not his attacker. The charges were then dismissed.
