Plaintiff's car was properly licensed, registered, and inspected, displaying proper certification. Plaintiff also had a valid driver's license and did not operate his car recklessly or in a manner justifying a police stop or questioning. Defendants Eiseman and Hujber were driving up the street when they noticed officers from the 32nd Precinct stop to address a fight between a man and a woman. Defendants Eiseman and Hujber stopped to assist with the fight, but instead walked to Plaintiff's car. Plaintiff was not involved in the fight and was just sitting in the driver's seat of his car. \n\nDefendant Eiseman falsely stated that he saw the person who was seated in the passenger seat place drugs in his pocket and asked the passenger and Plaintiff to get out of the car, to which they complied. Defendant Hujber falsely stated that he saw white powder residue on the back of Plaintiff's pants. Plaintiff's vehicle was searched and no drugs or contraband was found in Plaintiff's vehicle. Plaintiff and his passenger were arrested. Based on Defendants Eiseman and Hujber's false statements, the DA's office decided to prosecute Plaintiff for possession of a controlled substance.
