The defendants obtained a search warrant based on false information alleging the presence of drugs. They kicked in the bedroom door, pointed a gun at Mr. Roberts, and physically restrained both plaintiffs with excessively tight handcuffs. Mr. Roberts' father, who was in the living room, was similarly restrained. The defendants broke doors and searched the apartment. At the NYPD 75th precinct, the plaintiffs were fingerprinted, photographed, and searched. Despite requests, Mr. Roberts was denied access to his medication. Ms. Roberts received a desk appearance ticket, and Mr. Roberts was detained for 28 hours. The defendants fabricated evidence and falsely charged them with drug possession. The charges against Mr. Roberts were dismissed on February 26, 2020 in his favor, and the district attorney declined to prosecute Ms. Roberts. The officers claimed to be looking for their son, Kyle Adams, but Kyle was not present at the residence. Despite informing the officers that they had an active order of protection against Kyle, both Maye and Marcus were handcuffed, searched, and taken to the 75th Precinct. While in custody, Maye suffered a heart attack and was taken to NYU Langone Hospital for treatment. Marcus was released after 10 hours when the District Attorney’s office declined to prosecute her. Maye was released after approximately 24 hours and arraigned on charges that were later dismissed on June 12, 2019. The defendants held the plaintiff and his friend on the steps of the house of the raid and tightly handcuffed them to perform a search of the plaintiff, resulting in finding no contraband on the plaintiff. When asked for the reason of his arrest, the officers claimed that the plaintiff had obstructed their entry into the premises and that they found the plaintiff in the backroom of the house where the raid took place with a backpack full of drugs.
