They stopped at a yellow traffic light, when P.O. Brendan Cronin, who had been heavily drinking all day, grabbed his service weapon from his parked car and repeatedly fired from the rear of Mr. Borrelli’s car. Officer Cronin fired at close range at Plaintiff and Mr. Borrelli, who sat chatting in Mr. Borrelli’s stopped car, emptying his ammunition clip. Plaintiff was struck by the fired bullets but had no idea where they were coming from. The bullets moved from right to left, striking Plaintiff and then methodically moving toward the driver’s side towards Mr. Borrelli. Plaintiff was shot by six bullets and an additional bullet fragment that lodged in his head.As soon as the shooting stopped, Mr. Borrelli sat up and sped off to get Plaintiff to a hospital. Plaintiff was alternating between consciousness and unresponsiveness. Hospital staff and a P.O. helped remove Plaintiff from the car and began treatment to save his life. \nAfter watching Mr. Borrelli’s car drove away from the scene of the shooting, Officer Cronin got into his car and drove away with his hazard lights on. A police car caught up to Officer Cronin’s vehicle about a quarter mile from the shooting. Officer Cronin brandished his NYPD issued gun out of the car window and ignored orders from local police to drop the weapon. In response to threats that he would be shot, Officer dropped the weapon out of the car window and was taken into custody. While in custody, Officer Cronin refused to take a breathalyzer test and denied any recollection of the shooting. NYPD investigators began retracing Officer Cronin’s steps prior to the shooting, questioning staff at Alehouse where he had been drinking. Initially charged with only assault, a grand jury later issued indictments against Officer Cronin for assault, attempted murder in the second degree, and operating a motor vehicle while intoxicated. He pled guilty to the charges and received a nine year prison sentence. Sgt.
