Defendants John Duffy, Falcon, Daniel O'Grady, and Benjamin Bellingeri failed to exercise their command authority to intervene to stop the assault. Due to being pushed by the fencing, and blinded by the deployment of pepper spray by defendants Vega and John Doe \"Second Pepper Spray Officer,\" plaintiff fell to the ground and broke his hand, suffering a spiral fracture.
