Because it was Thanksgiving Day, there was a police presence around the store. At about 9:30am, plaintiff advised several unidentified NYPD officers that he was required to unlock the side doors of the store at 10:00am in compliance with fire regulations. The officers told plaintiff that he was not allowed to do so. Plaintiff informed defendants that he would have to call the Fire Department regarding the matter. A few minutes later, defendant officer ROBERT ZEVON arrived and spoke to the officers already on the scene and then told plaintiff to \"back the fuck up.\" Plaintiff complied. Officer ZEVON then twice more demanded that plaintiff back up, and although plaintiff complied with all instructions, ZEVON directed the other officers to arrest plaintiff and sprayed mace into plaintiff's face and eyes as plaintiff was being held by the arresting officers.","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nysd.419863/gov.uscourts.nysd.419863.1.0.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/13055828/milliken-v-the-city-of-new-york/"}],"discipline":[{"disposition_date":"2019-04-08","case_no":"2019-20336","penalty":"Dismissal probation (12 months), pre-trial suspension days (31 days), vacation days (59 days)","charges":[{"desc":"Misuse of time.","disposition":"Pleaded Guilty"},{"desc":"Off-post.","disposition":"Pleaded Guilty"},{"desc":"Failed to make required in Department logs.","disposition":"Pleaded Guilty"}]}],"documents":[{"url":"https://www.documentcloud.org/documents/22119858-905333_05282021_2021025pdf","date":"2021-05-28T00:00:00.000Z","type":"trial-decision"},{"url":"https://www.documentcloud.org/documents/24441170-bronx-notified-officers-list-edited_redacted-redacted_redacted","type":"credibility-finding"}],"id":"C7Q7","url":"https://www.50-a.org/officer/C7Q7"}
