Plaintiff was not engaged in any illegal or suspicious activity and complied with the officers' requests. Defendants were not invited on the premises and their presence was not consented to by Plaintiff, no exigent circumstances existed, and the officers did not display a warrant and refused to produce one when asked. Plaintiff was handcuffed while the officers searched the premises, where they found no evidence of criminal activity. Despite this, Plaintiff was arrested and transported to the 115th Precinct in Queens County, held off several hours and ultimately transported to Queens County Central Booking for many hours. Plaintiff was placed in a lineup by defendant Mulcahy, where the defendants claim plaintiff was identified by a historically unreliable witness as having committed a robbery 9 months prior to his arrest. The lineup consisted of various fillers who bore little resemblance to plaintiff.
