The defendants arrived at 951 Hoe Avenue in the Bronx in response a call made to 911 regarding an unattended five year old child. Mr. Olivo and Ms. Olivo were watching said five year old child while Mr. Olivo and Ms. Olivo’s mother, Ms. Perez, was away from the residence. The Olivos call Ms. Perez upon the arrival of the defendant police officers at the residence. Ms. Perez rushed home and began recording the defendants outside the residence door. One of the defendant police officers then illegally confiscated Ms. Perez’s phone and refused to allow her to enter her own residence. Ms. Perez was then arrested by defendants, illegally searched, and transported to Lincoln Hospital in handcuffs. Subsequently, defendants demanded that Mr. Olivo open the residence door. Mr. Olivo opened the door slightly but did not unchain the door’s lock. The defendants then broke through the door and gained entrance to the residence despite not having a warrant and despite the lack of exigent circumstances. Defendants, including Defendant Castillo, entered the residence with weapons drawn and then slammed Mr. Olivo and Ms. Olivo to the floor and arrested and handcuffed them. Ms. Olivo was a minor of 16 years at the time. A defendant then unlawfully searched Ms. Olivo, including by fondling her breasts and vagina, which caused Ms. Olivo to scream that she was “being touched.” Mr. Olivo, while handcuffed, verbally protested the treatment of Ms. Olivo. In response, Defendant Castillo and other defendants kicked Mr. Olivo in the face and body several times, and then tasered him six (6) times. Mr. Olivo lost consciousness as a result. Thereafter, Mr. Olivo and Ms. Olivo were transported to Lincoln Hospital and detained for 26 and 24 hours, respectively. Then, Mr. Olivo was transferred to the 41st NYPD Precinct and Bronx Central Booking before his release without any charges on April 21, 2016.
