Plaintiff fixed the gate and shortly thereafter Det. Kevin Roy, Sgt. Neil Nappi, PO Brian Jay, Det. John Hourican, PO Mike Hernandez, Capt. Gerard Staples, Inspector FNU Cully, Det. FNU Booper, and POs John Does 1-10 falsely arrested Plaintiff for possession of a controlled substance. POs caused a malicious prosecution to be commenced against Plaintiff, and a November 2005 trial resulted in a mistrial. In May 2006 the charges were retried and Plaintiff was sentenced to 25 years to life but Plaintiff's appeal successfully won a new trial. In a June 2014 trial Plaintiff was fully acquitted. Plaintiff remained incarcerated throughout these trials. Defendants yelled at plaintiff to get on the floor. Plaintiff complied with the orders to get on the ground and was handcuffed. Plaintiff was arrested and transported to the 25th precinct. Plaintiff was transported to Manhattan Central Booking. After 18 hours in custody, the Manhattan DA declined to prosecute plaintiff and he was released.
