The Plaintiff and friends were forced to exit the vehicle and an officer rushed Plaintiff, throwing him onto the ground, causing his face to strike the concrete. The Plaintiff, his friends, and the car were searched, and no contraband was found. Plaintiff was not read his Miranda rights nor told why he was being handcuffed, arrested, placed into a patrol vehicle, and transported to the 73rd precinct. He was detained for approximately 10 hours before being released with no charges filed. Officer Denis O'Hanlon, although hearing Plaintiff's ex-partner admit that Plaintiff was never physically abusive, engaged in the same confirmation bias as Officer Driscoll and failed to void Plaintiff's arrest. As a result, Plaintiff was suspended without pay for 30 days. He was charged for four misdemeanors and violations, in which three were dismissed and one he pled guilty to. Plaintiff was restored to duty on modified assignment. \n\nOn or about September 28, 2022, Plaintiff was falsely arrested by Officer Elvis Cornea based on text messages exchanged with Plaintiff's ex-partner. Plaintiff disagreed with his ex-partner regarding the health, safety, and welfare of their minor children, and criticized her over text. Officer Elvis falsely arrested him due to confirmation bias related to his gender and race as the aforementioned text messages are not \"objectively\" violative of any law or court order. Officer James Wilson also failed to void the false arrest because he engaged in the same confirmation bias. Plaintiff was suspended without pay for 30 days, and was restored to duty on modified assignment. The two had been romantically involved for years, and Plaintiff Clark was a lawful tenant of the premise. While Plaintiff Bussey was checking with Plaintiff Clark on her whereabout on the seventh floor and later descending from the staircase, Defendant Police Officers entered and fanned throughout the lobby of the premises as part of a vertical patrol. In the stairwell between the fifth and sixth floors Defendant Garcia told Plaintiff Bussey to “come here!” without identifying himself, and Plaintiff Bussey abruptly turned around and retreated upstairs to the seventh floor hallway. \n\nWhen Plaintiff Bussey was waiting with his hands raising on the seventh floor, Defendant Garcia immediately thereafter entered the seventh floor hallway\nfollowed by Defendant Cornea and Police Officers Doe 1-5. While Plaintiff Bussey explained that he was a guest and therefore was lawfully present, the defendants grabbed Plaintiff Bussey by both arms, forced him to the floor face-first and, without probable cause, provocation or warning, immediately began assaulting him with fists, shod feet and foreign objects, attacking his legs, knees, thighs, back, ribs and head. After being removed to the near precinct, Plaintiff Bussey was subject to a body-cavity search with negative results and was delayed medical care despite being visibly injured. Defendants charged Plaintiff Bussey with felonious assault upon a police officer, resisting arrest and multiple counts of trespass.
