Other Defendant officers pressed their knees on Plaintiff's neck & back as he was handcuffed, and Plaintiff repeatedly informed them that he could not breathe. These complaints were ignored and Plaintiff soon lost consciousness, coming to inside of an NYPD vehicle. Inside the vehicle, Plaintiff informed officers that the handcuffs were overly tight, causing bruising to his wrists, but this was ignored. While the plaintiff was speaking with the brothers, 15-20 individuals with motorcycles, whom the plaintiff did not know, were also present. At approximately 6:50 p.m., police officers, including Sergeant Gabriel Cuevas, arrived at the scene and ordered everyone to disperse.\n\nThe plaintiff was about to enter the brothers’ property to avoid being subjected to the officers' orders, but Sergeant Cuevas screamed at him to leave. When the plaintiff attempted to explain his connection to the residents, Sergeant Cuevas became angry and, without provocation, charged at the plaintiff, pushing him onto a nearby motorcycle. Several officers then assaulted the plaintiff, punching him for about ten minutes without legal justification, causing injuries to his back, ribs, and earlobes.\n\nDespite his visible injuries and difficulty breathing, the plaintiff was unlawfully handcuffed, searched, and falsely arrested without probable cause. He was transported to the 77th Precinct, where he requested medical attention. The plaintiff was taken to two hospitals for treatment of his injuries, including severe bruising to his ribs. He was detained for over 40 hours and charged with assaulting Sergeant Cuevas based on fabricated allegations. Kenton, Williams and Grant were transported to Central Booking.  Kenton spent 7 hours there before being released without being charged.  Williams and Grant spent 15 and 20 minutes there without being charged.  Robb was released at the precinct without having been charged.\nWilliams and Robb suffered permanent physical and mental injuries as a result of the excessive force employed by defendants.  Plaintiff Unique (the barbershop) was searched without warrant or probable cause. Despite being stopped, Defendant Officers Ramon Portillo, Gabriel Cuevas, Leandro Cruz, Joongsuk Hwang and Justin Kelly and Sergeant Thomas Hardell tackled Plaintiff.  Despite offering no resistance, Defendants collectively severely beat Plaintiff with fists and hard objects.  \n\nPlaintiff was taken to the 83rd Precinct but due to his injuries he was transported by ambulance to a hospital.  After treatment for substantial head injuries, Plaintiff was returned to the 83rd Precinct.  However, because of continued pain, Plaintiff was taken back to the hospital for further treatment.  Before continued treatment, he had to be showered to remove insects that had infested Plaintiff at an unsanitary bathroom at the 83rd Precinct.
