Plaintiff went to the officers and they told him they had a warrant for him. Plaintiff went with the police officers. Officers placed plaintiff in a van and took him to the 115th precinct. At the precinct, officers took plaintiff to the second floor. A detective asked plaintiff if he knew why he was there and plaintiff said no and was told he had two warrants. Plaintiff was taken to an interrogation room and asked by Fogus about an attempted murder. Plaintiff had no information about an attempted murder or other crimes. On January 17, 2015, Fogus prepared a photo array containing plaintiff's picture, but the eyewitness did not recognize anyone in the photo array. At the precinct, plaintiff was placed in and subjected to a highly suggestive line-up to frame him. Fogus claimed an eye witness to the crime identified plaintiff in the line up. Defendant Laurendi placed plaintiff under arrest and took him to central booking. At central booking, Fogus and Laurendi, prepared false reports stating plaintiff committed various crimes on December 28, 2014. Plaintiff told police he was not involved in the shooting but the prosecution proceeded. Defendants drafted and submitted police reports and signed a sworn criminal court complaint to subject plaintiff to prosecution and unfair trial. From January 22, 2015, plaintiff was on Rikers Island, until December 12, 2016. During that time, on February 22, 2015, April 17, 2015, and October 10, 2016, plaintiff was assaulted by numerous detainees. Due to the conditions of his confinement, plaintiff attempted suicide.
