Pinto was kneed in the face; kicked in the legs, arms, and body; cut on his leg; stomped on his right hand; and handcuffed. Pinto’s thumb was broken and fragmented, his leg lacerated, and had bruising, swelling, and abrasions along his head and body. Pinto was transported by ambulance to Brookdale Hospital; he stayed handcuffed and was accompanied by defendants in the ambulance. At the hospital, Pinto complained of pain in his hand, but P.O.s rushed him out of the hospital after doctors repaired the laceration on his left leg with stitches. As a result, his broken bone was not identified.\n\nPinto was detained at both the 75th precinct and in Kings County Central booking. While in Central Booking, Pinto was examined by a medical technician who noted the injury to his hand. Finelli falsely swore to and signed a criminal court complained which contained manufactured and false allegations that Pinto resisted a lawful arrest and refused to be handcuffed. Finelli was not arraigned until 48 hours after his arrest.
