Plaintiff was unlawfully arrested and handcuffed by the \nDefendant Officers without legal justification or probable cause, transported to the 71st Precinct. They provided false and misleading information that Plaintiff committed a crime, specifically that he was in possession of a w weapon while under the influence of drugs. Plaintiff remained in custody for 24 hours until December 3, 2021. Officer Rodriguez exited the vehicle and struck Plaintiff in his left eye and temple area with a closed fist holding a metal handheld flashlight, knocking plaintiff unconscious. Plaintiff later required 12 stitches. When Plaintiff regained consciousness, Officer Rodriguez restrained Plaintiff by placing his knee on Plaintiff's neck even though Plaintiff was handcuffed. Plaintiff was detained, searched, and questioned while surrounded by approximately 20 other officers on the street then searched again at the precinct and detained in a room without medical treatment. An EMT/EMS employee eventually determined Plaintiff required hospitalization, and Plaintiff was transferred to the hospital in handcuffs for 8 hours while being treated before being transported back to the precinct for another 2 hours until his parent arrived.
