During the parade, a violent fight broke out near the plaintiff and the plaintiff was punched in the lip and another man was stabbed. Shortly after, police responded to the situation and spoke with the man that was stabbed but the man could not identify the initial aggressor in the altercation. \n\nAfter speaking with the man, the police officers observed the plaintiff bleeding from his lip and walked toward him. The plaintiff put his arms above his head and pleaded with the defendant officers that he was also a victim of the fight. The officers used excessive force by pushing the plaintiff into a guardrail, slamming him into the ground, and kneeing the plaintiff in the back. Subsequently, the officers conducted an unlawful search of the plaintiff's person without probable cause. During this search, the officers discovered a legal box cutter in the plaintiff's pocket that he informed the officers he used for work. The officers concluded that this box cutter was the weapon used to stab the man in the altercation even though there was no blood on the item and it was not the right size to have caused the man's injuries. The officers falsely arrested the plaintiff without any probable cause or justification and transported him to the 25th Precinct to be fingerprinted and photographed. \n\nThe plaintiff suffered severe and extreme injuries as a result of the defendant officers' excessive force. The officers pushed their knees into the plaintiff's back while he was laying on his back and placed handcuffs in an unreasonably tight manner, causing the plaintiff's wrists to bleed. The plaintiff did not receive medical attention for his injuries until 9:00 p.m. that day.
