About fourty-five minutes later, Officer Jane Doe announced that everyone in the street was to clear the roadway. Plaintiff was in the crosswalk with the \"walk\" light on, and when he reached the other side, the sidewalk was blocked by other demonstrators, police, a police vehicle, and a trash can. Plaintiff was instructed to get out of the crosswalk and onto the sidewalk and tried to comply by seeking to step onto the sidewalk. Several seconds later, a supervisor ordered Plaintiff's arrest. Defendants Fuschetto and Jane Doe took hold of Plaintiff, bent him over the hood of a police car, handcuffed him, and brought him to a prisoner wagon. The handcuffs were excruciatingly tight, and Plaintiff complained about the pain to officers. The handcuffs were not removed for apprximately two hours. Meanwhile, Plaintiff was brought to One Police Plaza for arrest processing and remained there for nine hours. Plaintiff was prosecuted by the New York County District Attorney's Office on the basis of false charges by the police that he obstructed vehicular traffic and failed to comply with a lawful order to disperse.
