As he proceeded on the Lower East Side towards the Holland Tunnel, he was pulled over by several NYPD officers, including Officer Luis Perez. Officer Perez approached Plaintiff’s window and asked him if he had been drinking; Plaintiff indicated he had consumed a drink with dinner, which by this time was approximately 10 hours prior. Officer Perez made Plaintiff submit two roadside breath tests, said Plaintiff was on the “border”, and brought him back to the police station for further testing. At the station, Plaintiff was submitted to a chemical breath test, which returned a blood alcohol content of 0.04%, which is well within the legal limit. Plaintiff was also submitted to speech, balance, walk-and-turn, one-leg-stand, and finger-to-nose tests, all of which came back as “steady” or “accurate”. Nevertheless, Plaintiff was charged with driving under the influence of alcohol. After approximately 5 hours, Plaintiff was transported to Central Booking. He waited there for 15 additional hours before seeing a judge. Plaintiff was arraigned that morning on October 20, 2014, after which his case was adjourned for approximately one month.
