The night of July 12, 2014 around 11:00 pm, a taxi cab driver picked up decedent Ron Singleton in Manhattan and was driving south on Fifth Avenue towards the Empire State Building, when the driver became annoyed with decedent's travel directions. At 51 East 51st Street and 6th Avenue, the driver summoned a nearby police officer, defendant Officer Darian Shannon. Shannon ordered decedent out of the vehicle, and refused to identify himself when asked by the decedent, instead calling a code 10-85 for other officers to respond to the scene. Defendants Lt. Michael Gandolfi and Officers Smith, Holzapfel, Walsh, and Gallagher then arrived on scene, collectively removing decedent from the cab, forcing him to the ground, arresting and handcuffing him. Defendant was pinned to the ground with force applied to his back and neck by the six officers on scene, causing him to let out a scream and immediately become limp and unmoving.\n\nDefendant Sgt. Steven Cameron and defendant Officer Timothy Tierney then arrived on scene to see the decedent handcuffed and lying on the ground. Detectives Robert McGee and James Coll then arrived and placed decedent face down into a Posey Vest/Body Burrito device while he remained handcuffed. EMTs then arrived on scene and an unidentified NYPD Midtown North Sergeant refused to place the decedent on his back so he could be medically evaluated. An FDNY paramedic then arrived on scene and had to approach multiple officers before the patient was partially turned over and the Posey Vest was cut open, revealing the decedent to be in cardiac arrest. The FDNY paramedic and EMT attempted to provide CPR to the decedent, whose handcuffs officers on scene refused to remove.
