Michelle Berrio exited this stop shortly after and walked on 145th St. toward her son's child care provider. Plaintiff was approached by NYPD officer Gellison Flores despite her not matching the description of the assailant. Flores asked her if she had been in a fight, and she replied that she hadn't. Approximately 10 minutes later, officer Tommy Keung arrived in a police car with the woman who had been assaulted in the back seat.  Keung stated that the woman who had been assaulted, who had an untreated concussion, identified her. The officers handcuffed Berrio and arrested her. In the patrol car, they repeatedly asked about the assault without reading her her Miranda Rights. Berrio asked about being read her rights, and the officer told her that she \"didn't know this job.\" Joseph Finamore is recorded as the arresting officer in the arrest report.\nAt the station, Berrio asked several officers to review the surveillance cameras, but they did not immediately do so. When she was questioned, Finamore told her that she did not match the description of the assailant and questioned the arrest. Hours later, the officers reviewed the footage and found inconsistencies between the plaintiff and the perpetrator. Berrio had repeatedly asked for water and was denied until 12 hours after she was taken into custody. Approximately 3 hours after the police reviewed the video showing that Berrio did not commit the crime, Detective Brian Sessa released a report to the media falsely stating that the plaintiff was arrested for assault as a hate crime and would be arraigned later in the morning. The plaintiff was then told that the victim of the crime told them that she was not the suspect, and freed her from custody.
