Plaintiff Foxworth was grabbed from the vehicle and placed in handcuffs. Plaintiff Nieuenkirk was thrown into a police car where he was assaulted and battered once again by POs. Plaintiffs Nieuenkirk and Foxworth were taken to the 71st Precinct. While there PO Terrell threatened Plaintiff Nieunkirk with punishment of Plaintiff Foxworth if he sought medical attention for his injuries. Plaintiff Foxworth was released later that evening without being charged with a crime.
