All charges against him where dropped. \n\nPlaintiff Alex Gutierrez was struck with a baton, pepper sprayed, and put in excessively tight zip tie handcuffs. He was made to wait for hours until ultimately being put on a bus and transferred to an arrest processing facility where he waited for hours without food, water, or medical attention and was ultimately issued a pink summons by Police Officer Andre Jeanpierre . Despite this, Plaintiff was arrested for Criminal Possession of a Controlled Substance and held in the precinct for 8 hours before being released & issued a Desk Appearance Ticket. The aforementioned Defendants falsely informed the DAO that the two oxycodone pills were in Plaintiff's possession in order to initiate prosecution. Plaintiff accepted an ACD on November 2, 2017, and the charge was dismissed on May 1, 2018.
