James McCullough, Sergeant Michael Webber, Detective Vincent Barese, Detective Matthew Zito, Detective Walter Marin, Detective Erik Hirsch, Detective Jose Higa, Detective Jean Paul Jaccard, Detective Timothy Erwig, and Captain Gregory Stewart John (collectively the \"Defendants\") forcibly entered the residence of the Plaintiffs, screamed, curse and pointed firearms at the Plaintiffs. The Defendants also threatened the Plaintiffs with, among other things police dogs. The Defendants pushed Plaintiff Betty Claus by the face into a wall, refused to allow her to cover her chest up despite only being in a bra. The Defendants also punched Plaintiff Andres Cruz in the stomach and physically forced him to lie down on his stomach at gunpoint. Further, while Plaintiff Cruz was on his stomach, the Defendants placed a finger in his mouth and pulled his neck back while simultaneously pulling one of his legs back towards his head, thereby causing substantial pain. The Defendants further illegally searched the Plaintiffs, strip searched Plaintiff Cruz, handcuffed and interrogated the Plaintiffs. The Defendants then \"ransacked\" the apartment, causing damage to the personal belongings of Plaintiffs Rosario, Concepcion and Claus. The Defendants then transported Plaintiffs Claus and Cruz to the local precinct and ultimately to central booking. The Defendants set forth fabricated charges against Plaintiff Cruz, initiating a criminal prosecution against him for the possession of marijuana. The charges against Plaintiff Cruz were ultimately dropped. However, Plaintiff Cruz was held in custody for 19 days AFTER the charges were dropped. Plaintiff Claus spent two days in police custody.
