Defendant Officers Genao, Lara, and Feliz then approached, stopped and arrested Plaintiff and Gorfti for \"jumping the turnstile\" and/or \"doubling up.\" Plaintiff and Gorfti denied doing either of those things, showing their Metrocards to the Officers and urging them to verify that they were used. Even though a booth attendant was on duty, Officers did not ask the attendant to verify. Plaintiff and Gorfti protested their arrest without raising their voices or using inappropriate language; their protests angered Defendants. Officer Genao swore at Plaintiff and Gorfti, sayiing \"shut the fuck up\" and, in sum and substance, \"if she were a man, she would them up.\" Officers Feliz and Genao disparaged their national origin, saying \"Moroccans are animals,\" \"You beat women,\" and \"You cannot do it over here.\" Plaintiff was handcuffed excessively tightly behind his back and asked a female officer to loosen the handcuffs, but she refused to do so. Plaintiff and Gorfti were taken to a police area in the subway station at Broadway and Canal Street and later to Central Booking. Officers Genao, Lara, and Feliz conspired to prepare and did prepare a false and misleading police report which they sent to the New York County District Attorney's Office, which decided to prosecute Plaintiff and Gorfti. The next morning, Plaintiff and Gorfti were separately arraigned. Each pleaded not guilty and declined an offer by the District Attorney for an adjournment in contemplation of dismissal. They were released on their own recognizance.
