The officer struck Plaintiff’s neck with his arm, “clotheslining” Plaintiff. This caused Plaintiff to fall off his bicycle and briefly lose consciousness. The officer then handcuffed Plaintiff and transported him to the 83rd Precinct, where Plaintiff was shackled and ordered to strip nude. While naked, Plaintiff was touched inappropriately by defendant police officers without his consent. In addition, while at the 83rd Precinct, Plaintiff asked to be taken to the hospital for medical treatment, because he was suffering the rejection of his kidney implant. Although defendant police officers were aware that Plaintiff was suffering the rejection of his kidney implant and required medical attention, they refused to provide medical treatment or take Plaintiff to the hospital. \n\nAfter approximately 12 hours at the 83rd Precinct, Plaintiff was transferred to Central Booking. While Plaintiff remained in custody, defendant police officers falsely told the District Attorney’s office that Plaintiff was engaged in obstruction of governmental administration at the time of his arrest, and that he was in possession of a controlled substance at the 83rd Precinct. Despite these allegations, defendant police officers never recovered any drugs or other illegal contraband from Plaintiff’s custody or control, and defendant police officers had no reason to accuse Plaintiff of any crimes.
