Plaintiff let the Police into the residence with his keys. The defendants refused to arrest the male burglar and instead questioned plaintiff about whether he really lived there. Plaintiff showed the police his signed lease and protection order stipulating conditions for his residing there. Despite this, the Defendant police proceeded to unlawfully arrested plaintiff. Defendant polcie threw plaintiff into a wall, smashed his face on a closet, tightly handcuffed plaintiff and roughly dragged him out of the apartment causing  his face and body to hit several walls on the way out where he was threwn into the back of the polie car. Plaintiff did not resist arrest or otherwise challenge the defendants. The plaintiff at various points, including at the police station, expressed that he was having difficulty breathing and after a delay of several hours medical attention was eventually sought for him due to his asthma. Defendant officers mocked, ridiculed, and verbally abused plaintiff when he was having breathing problems and begging for medical attention at the precinct. The Defendant police and DA office inititated a malicious prosecution by arresting him without probable cause and fabricating false charges. Plaintiff was arraigned in criminal court on August 31, 2011.
