The officers seized his two iPhones and other property, and have refused to return them. Plaintiff was remanded without bail and incarcerated for almost three years, before being found not guilty on December 7, 2016. Five named officers involved in the investigation, arrest, and prosecution of plaintiff had been involved in a previous arrest of plaintiff: Detective Kevin Goodspeed, Detective Anthony Puleo, Detective John Roberts, Sergeant Bryan Pierre, and Detective Gary Haber. Leading up to the February 4 arrest, these officers presented falsified records and pressured witnesses. Sergeant Pierre made false statements about an interview with a witness. Detective Goodspeed (the lead investigator) repeatedly pressured a grand jury witness, who later recanted. \nThe previous arrest occurred on April 9, 2012, at or near a jail in Queens. Leading up to that arrest, Detective Haber falsely represented statements made by a witness. Shortly after the arrest, Detective Roberts, Sergeant Pierre, and another officer physically assaulted plaintiff. After lengthy detention at the precinct, Detective Roberts and others made false statements to get charges filed. Plaintiff was held at Rikers for several months. Plaintiff was brought back to the precinct for a lineup, after which Detective Haber and other officers physically assaulted plaintiff and placed him in a chokehold. Charges were dismissed on November 13, 2012.","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nyed.414146/gov.uscourts.nyed.414146.57.0.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/7111850/demosthene-v-the-city-of-new-york/"},{"name":"Pressley, Leroy vs City of New York, et al.","start_date":"2016-07-12","payout_amount":0,"disposition":"","docket":"708149/2016","court":"Supreme Court - Queens","officer_name":"Roberts, John","summary":"On or about April 22, 2013, Leroy Pressley (plaintiff) was wrongfully arrested by members of the NYPD, including Officers Pierre, Roberts, Mara, Lavin, and Gamrat (defendants), for a shooting that occurred. The defendants entered the plaintiff home without a warrant or consent, conducted searches and arrested him without probable cause. The plaintiff was not informed of his Miranda rights. \n\nThe defendants manipulated a lineup identification procedure to ensure the plaintiff’s identification, despite a lack of credible evidence. The illegal search of the plaintiffs home was not communicated, exculpatory evidence was suppressed, and the DA was never informed about the unlawful searches. This misconduct resulted in an unjustified detention, malicious prosecution, and a denial of procedural and substantive due process under the Fourth and Fourteenth Amendments of the U.S. Constitution. \n\nThe plaintiff was detained without a warrant until all charges were dismissed on April 30, 2015. \n\nThe plaintiff was the subject of malicious prosecution, false arrest, suppression of evidence, and conspiracy with the defendants, acting under color of law, wrongfully accusing the plaintiff of a crime he did not commit. The defendants fabricated and hid crucial evidence while failing to conduct proper investigations.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=XVa9UkBW65ga2q8JUjtlyQ==","type":"complaint"}]},{"name":"Demosthene, Kroutchev vs City of New York, et al.","start_date":"2014-05-06","payout_amount":0,"disposition":"","docket":"14CV00816","court":"U.S. District Court - Eastern District NY","officer_name":"Roberts, John","summary":"On or about April 9, 2012, police officers falsely arrested Plaintiff without cause, and charged him with robbery and other charges. The officers tightly handcuffed Plaintiff with his hands placed behind his back and forcibly pushed him into their police vehicle. During the ride to the precinct, officers punched Plaintiff on his chest on multiple occasions and physically and verbally assaulted him. Eventually, after detaining Plaintiff at the precinct for a lengthy period of time, Plaintiff was transported to the Central Booking to await arraignment. Officers provided false information to the DA, based on which prosecution was commenced. Since Plaintiff could not make bail, he was transported to Rikers Island, where he was incarcerated for several months. \n\nWhen months had passed, Plaintiff was placed in a lineup. Plaintiff was not picked. As Plaintiff was thereafter being led away from the lineup in handcuffs and restraints, officers physically and verbally assaulted him. They ceaselessly threatened and taunted Plaintiff and made several derogatory comments directed at him. In the face of the threats and abuse, Plaintiff merely indicated that the officers were abusing their authority. In retaliation, officers grabbed Plaintiff and placed him in a chokehold. He was then denied medical care for his injuries. Eventually, on or about November 13, 2012, the false charge(s) levied against Plaintiff were summarily dismissed. Following that, Plaintiff was released from detention after approximately seven months of unlawful incarceration.
