This arrest was based on an allegation by a complainant who had six open criminal cases being prosecuted by the Kings County DA. The case against plaintiff was dismissed on July 26, 2013 and he was released.\n\nOn January 21, 2013 plaintiff was arrested again by Detective Zambito and charged with felony offenses including attempted murder in the second degree. This arrest was based on allegations by the same complainant as the first. Plaintiff's counsel hired a private investigator who spoke to a sergeant in the 62nd Precinct, who said that the complainant was a known drug dealer and had made false accusations in the past. Plaintiff's counsel communicated this to defendant Cronin. The DA's office still had the complainant testify to a grand jury, despite being advised of his reputation. The Assistant DA also filed a motion to have plaintiff's counsel removed from the case for an alleged conflict of interest (which was denied).
