Plaintiff was denied the right to due process and a fair trial until the resisting arrest charges against Plaintiff were dismissed and sealed on or about March 15, 2021. Lombardi and other representatives of the 67th precinct had contacted Plaintiff demanding that he cancel his cultural event at his cafe, and did not provide justification when Plaintiff asked why. After the shut down, Plaintiff met with defendant Community Affairs Officer Nelson who told him to cancel all future events scheduled, including his most profitable weekend event, as the NYPD did not want any crimes to occur. Officer Nelson acknowledged that the cafe was not the cause of any such crimes in the past, but threatened shutting down the cafe and arresting all attendees if an event occurred. Officer Nelson ultimately demanded that no other major events ever be held at the cafe. A similar shutdown occurred on February 18, 2017, even though the liquor license and occupancy count were lawful, and on that instance defendant officers damaged plumbing in the mens room. The defendants were aware that plaintiff was neither the owner of the premises nor listed on the liquor licenses. Nevertheless, defendant-officers approached the plaintiff, interrogated him, prevented him from leaving or alerting the business owner, and subsequently grabbed, shoved, and searched the plaintiff against his will. The defendants proceeded to handcuff the plaintiff outside of the premises, where he was held for thirty (30) minutes in view of patrons or other persons who knew of plaintiff's association with the restaurant. Defendants then placed plaintiff, still handcuffed, into a police van, where he was held for an additional thirty (30) minutes before being processed at the 67th Precinct, held for approximately ninety (90) minutes, and transferred to central booking. \n\nDefendant NYPD officers, including defendants Lt. Chou, and Officer Aurel Hoxha (Shield No. 13176), initiated and maintained false criminal proceedings. Specifically, defendant-Officer Hoxha alleged that they witnessed the plaintiff unlawfully possess, sell, store, and sell alcohol without a liquor license. Defendants Hoxha and Chou were made these claims deliberately to prevent, curtail, or harass Caribbean owned businesses from engaging in ethnically and culturally-styled music and entertainment events. Additionally named, though whose actions are not specifically stated are Lt. Lombardi and Officer Nelson of the 67th Precinct. On January 29, 2017, plaintiff was arraigned and released without bail. Plaintiff made four (4) additional court appearances before the Kings County Criminal Court.
