The Plaintiff is a female who practices Islam and wears a Hijab in accordance with the religion’s teachings. When she arrived at the precinct, she was arrested, processed, photographed, and placed in a holding cell. She was taken out of the holding cell and handcuffed to a bench from 7:00pm to 6:00am in order to accommodate male detainees. She was then transferred to Central Booking, where she was taken to the photographing area where approximately ten male police officers and five male detainees were present. Officer Ivan Williams directed her to stand in a certain location to have her photograph taken, and told Officers Quinones and Polyak that she needed to remove her hijab for the photo. \n\nOfficers Quinones and Polyak told the Plaintiff to remove her hijab, and she told the officers she could not remove her hijab in the presence of men for religious reasons. She requested a female officer to take her photograph in private. In response, Officer Williams ridiculed her request and said “unless you want to go back to the precinct you have to take that off.” All three officers insisted the Plaintiff remove her hijab and she ultimately complied. When she removed her hijab, the men, including officers Williams, Quinones, and Polyak, stared and made comments about her hair. Officer Williams commented “wow, wow, wow” in reference to the plaintiff’s hair when taking the photograph.
