Defendant Officers filed false and/or misleading statements that they observed Plaintiff to be fidgeting in the back seat of the livery cab, that they observed Plaintiff making furtive movements towards the right side of his body, that they smelled marijuana, that they observed Plaintiff pointing his head and eyes towards the right side of his body, and that they observed a visible bulge on the right side of Plaintiff's body. On or about November 22, 2016, Plaintiff's motion to suppress was granted in its entirety and the judge held that the defendant officers did not have reasonable suspicion to search Plaintiff based on inconsistencies in their individual testimonies and between their testimonies and the paperwork filed in connection with the arrest.
