At the aforementioned place and time, Plaintiff was inside his bedroom getting ready for his shift at work. The plaintiff overheard the downstairs bell go off, and then heard his roommate buzz the visitor or visitors inside. Plaintiff then overheard yelling and screaming at the apartment door, and when he came out of his room to see the commotion he was met by a defendant police officer who pointed a gun directly into his face. The defendant officer instructed the plaintiff to get down on his knees with his hands behind his head, and Plaintiff complied. The plaintiff then watched as approximately ten (10) defendant police officers in plain clothes searched his apartment as well as his roommate. It was at this time that the defendant officers began to arrest the plaintiff, subjecting him to unlawful pat-down search and tightly restraining him with metal handcuffs. At no time relevant herein did Plaintiff commit a crime or violate the law in any way, nor did the police officers have an objective reason to accuse Plaintiff of committing a crime or violating the law in any way. At no point did Defendant Officers recover any drugs, weapons, graffiti instruments, or other illegal contraband from Plaintiff or from a location that was in Plaintiff's possession, custody, or control. Plaintiff did not resist arrest. Nevertheless, Plaintiff was unlawfully arrested and handcuffed by the defendant officers without legal justification or probable cause, and was thereafter placed in the back of a van and transported to an NYPD Precinct; upon information and belief, the 9th Precinct. Upon his arrival at the Precinct, Plaintiff was unlawfully fingerprinted, photographed, and placed in a holding cell. While at the precinct, the plaintiff was interrogated by defendant officers about his roommate dealing drugs, about which the plaintiff knew nothing. Plaintiff was never mirandized by defendant officers. While Plaintiff was in custody, the defendant police officers provided the New York County District Attorney’s Office with the false, misleading, and/or incomplete information that Plaintiff committed a crime.\nSpecifically, the defendant police officers falsely stated to the New York County District Attorney’s Office that Plaintiff was engaged in Criminal Possession of a Controlled Substance. After approximately seven (7) hours in unlawful custody, the plaintiff was released from the precinct with a desk appearance ticket. Plaintiff was forced to hire a private criminal defense attorney at a cost of $5,000 to defend himself against these false charges.
