Collins informed immediate police officers, and medical staff that he was unable to identify his shooter. At the time of his admission to Jacobi Medical Center, Collins had a positive blood alcohol level of 0.164 at the time of his admission. Collins would later identify '2Gee' as the shooter to a medical staffer and Defendant-NYPD Detective James A. McBrown. Defendant-McBrown and defendant-NYPD officers Adela Rodriguez,  Scott Patterson, Patrick Sullivan, Michael Fahy, subsequently pursued plaintiff in connection with the shooting. On October 28, 2018, at approximately 7:50 p.m., defendant-McBrown performed a suggestive identification, and showed Collins a single photograph to Collins of a suspect. The photograph was of the plaintiff. \n\nOn October 30, 2018, plaintiff was charged with numerous crimes, including attempted murder, attempted assault, and criminal possession of a weapon. Plaintiff was held in custody at the NYC Department of Corrections at Rikers Island. On November 13, 2018, a probable cause hearing was conducted; plaintiff requested to appear. No witnesses appeared. On November 13, 2018, a State Board of Parole Preliminary Violation Hearing issued a declaration finding that the Department of Department of Corrections and Community Supervision did not find probable cause to support the charges against plaintiff, and declared \"the warrant is lifted\". Plaintiff was entitled to be released from incarceration but remained detained. On June 11, 2020, plaintiff was released from the Department of Corrections at Rikers Island. On January 5, 2022, Assistant District Attorney Rachel Taverna submitted a recommendation for dismissal of the indictment against plaintiff.
