While in custody at Central Booking, plaintiff was refused medical care for his ongoing panic attack and withdrawal symptoms by NYPD officer Jamel Brown. That evening, defendant Brown opened plaintiff's cell, reached in, and punched plaintiff while holding an unknown object to harden defendant's fist. The blow resulted in plaintiff losing consciousness and suffering a 2 centimeter deep cut above his right eye, in addition to diminished vision and psychological trauma. Following the assault by defendant Brown, plaintiff was left unconscious and profusely bleeding for two hours before emergency medical personnel were notified. Defendant Brown and NYPD Officer Juana Ortiz then falsely claimed that plaintiff Poulos had spit on defendant Brown and informed him that he was HIV positive, a claim made in order to ensure plaintiff's subsequent re-arrest and false imprisonment. \n\nPlaintiff Poulos was then transferred to NYC Department of Corrections custody at Rikers Island on May 7, 2013, and defendant Correction Officers Subernia Gordon-Hackshaw, Gregory Jerrick, and Patricia Thompson induced an inmate known to be a violent gang member to assault plaintiff, resulting in that inmate punching plaintiff ten times in the head. The three correction officers then intervened by spraying both the attacker and plaintiff with pepper spray, failing to properly decontaminate plaintiff afterward. On July 5, 2013, fellow inmate Christopher McFadden punched plaintiff in the face following a verbal altercation, prompting the DOC to briefly house them in different areas before re-housing McFadden in plaintiff's housing area.
