PO Michael Vasquez, PO Pierre Senat, and PO Francesco Monastra were in an unmarked police vehicle pursuing an individual in an ATV when their negligence caused the ATV to collide with Plaintiff's vehicle. Plaintiff lawfully filmed the scene and did not interfere with police activity. Regardless, POs attempted to stop Plaintiff from filming. When Plaintiff refused unlawful orders to leave PO Vazquez ordered Plaintiff to put his hands behind his back for \"standing in the street\" and suddenly violently propelled Plaintiff's head, neck, and upper body into the street in a \"suplex\" move. PO Vasquez then sat on Plaintiff while beating him together with PO Senat. PO Vasquez intentionally deactivated his body-worn camera when he began the assault. Sgt. Tatiana Cruz and Sgt. Louis Guglielmo arrived and approved of Plaintiff's false arrest. POs drove Plaintiff's car to the precinct to conduct an illegal search. Plaintiff was also taken into custody and was in and out of consciousness due to his head injuries. Plaintiff was maliciously prosecuted but the District Attorney declined to pursue the charges and Plaintiff was released without being arraigned.
