The officers giving the order included defendant NYPD Officers Giocardo Bernabe, Jamie Brantmeyer, and Nicholas Reina. Plaintiff obeyed this order, unlike two passengers in the vehicle who fled. Defendant officers found a \"booster bag\" (a burglary tool) and various Bed, Bath & Beyond merchandise items, all of which plaintiff disclaimed any knowledge of. Plaintiff was placed under arrest and did not resist. He was processed at the 1st Precinct, charged with being in possession of stolen property and a burglary tool, held in jail until his arraignment, and transferred to Riker's Island for the next six months due to his inability to make bail. Defendant Officers then allegedly made material misstatements of facts to bolster the case against plaintiff, expressing these misstatements in official police reports, to the prosecutor in plaintiff's case, and to the judge at plaintiff's Mapp/Dunaway hearing. Defendant NYPD Sergeant Louis Ventura allegedly falsely claimed the booster bag tool was found on plaintiff's person, despite not being present at the scene of the search.
