A vehicle driven by NYPD Officer Milko Mejia pulled up behind Plaintiff and sounded its horn. Plaintiff moved his vehicle so Officer Mejia could pass. Officer Mejia sounded his horn again, so Plaintiff moved his vehicle again. Officer Mejia pulled his vehicle to the side of Plaintiff’s vehicle and stated “you fucking asshole.” Plaintiff replied that Officer Mejia was the “asshole.” Plaintiff tried to drive his vehicle to the front of the store to pick up his wife. Officer Mejia stopped his vehicle in front of Plaintiff’s, approached the Plaintiff, and cursed at him. Plaintiff exited his vehicle and asked why Officer Mejia was cursing. Officer Mejia presented his NYPD badge. Plaintiff, who has an Egyptian accent, responded that Officer Mejia’s badge did not give him the right to curse at Plaintiff. Officer Mejia replied, “you’re a terrorist piece of shit, go back home.” Asserting his authority as an NYPD officer, Officer Mejia asked for Plaintiff’s car keys and driver’s license. Plaintiff refused. Plaintiff asked for Officer Mejia’s badge number so he could make a complaint. In response, Officer Mejia kicked Plaintiff in the groin, causing severe pain. Officer Mejia then repeatedly struck Plaintiff in the head, causing Plaintiff to fall to the ground, where he continued striking Plaintiff. Plaintiff attempted to retreat to his care; Officer Mejia continued striking him. \n\nOfficer Mejia stopped striking Plaintiff and called for police assistance, identifying himself as a police officer who was assaulted. Officer Mejia claimed the situation was “out of control” and the perpetrator was “trying to get away.” NYPD officers arrived at the location, where they spoke only with Officer Mejia and not with Plaintiff. The officers arrested Plaintiff. Plaintiff was bleeding and in visible need of medical attention stated that he needed an ambulance. That request was ignored. Plaintiff was taken to the precinct. He was later taken to the hospital and treated for multiple injuries.
