Plaintiff told the Defendant Officers that he was going to rep01i the incident to the Civilian Complaint Review Board. Upon hearing the Plaintiffs statement regarding the Civilian Complaint Review Board, Defendant NEW YORK CITY POLICE OFFICER FADOUL began to curse at the Plaintiff. Plaintiff attempted to get badge numbers but the Defendants tried to hide this information. \n\nBecause of this incident and emotional distress caused, Plaintiff. who suffers from acid reflux disease, was required to seek medical attention the next day at a local area hospital where he received medical attention. Defendants used excessive force by striking and holding onto Plaintiffs arm. Plaintiff had been a Family Care Provider since 2004. Prior to March 27, 2012, Plaintiff had been subject to an arrest; the DA’s office had declined to prosecute and the matter was dismissed. Following the arrest of Plaintiff, KPC had the residents staying at Plaintiff’s home removed. KPC then requested that Plaintiff should return the residents' belongings. Plaintiff had no objection to the return of the belongings and requested that proper procedure be followed and that the request be sent in writing. Instead of a formal letter requesting the residents’ belongings, on March 27, 2012, KPC employees arrived at Plaintiff’s home unannounced with two police officers, officers Chai and Fadoul. Neither the KPC employees nor the police officers had a warrant to search or seize items from Plaintiff’s home. When Plaintiff asked to see a warrant, the police officers stated that they did not need a warrant and blocked Plaintiff in a corner of her vestibule and prevented her from moving. The KPC officers entered Plaintiff’s home and without permission took all of the belongings of the residents and carried them out of the home.
