As he walked out, he accidentally brushed shoulders with a person who was part of a group. They exchanged words and the Plaintiff walked away home but the group followed him yelling at him and attacked him. The Plaintiff managed to run away and saw officers Matthew Grieve, Michael Montalvo, and Kelly Waugh. Instead of listening to and helping him, defendants Grieve and Montalvo put him into a chokehold, punched him in the ribs, slammed him on the ground, handcuffed him and threw him into the back of the police car. The defendants searched the Plaintiff and brought him to the 28th precinct for processing, and then to the hospital for medical attention. He had a boot print on his face, dirt and blood in his eyes, bruises and abrasions on his eye and forehead, injuries to the palms of his hands, and a suspected concussion. The Plaintiff was brought to Central Booking and then arraigned and sent to Riker's. One of the people involved in his attack claimed the Plaintiff placed his hand on her clothing over her genitals. As a result the Plaintiff was charged with forcible touching, possession of a controlled substance, sex abuse in the 3rd degree, and unlawful possession of marijuana. Since the Plaintiff was also on parole at the time, parole also held him based on these charges. \nOn November 5, 2019, the parole charges were dropped and the Plaintiff was released after being incarcerated for 142 days. The charges against him were dismissed and terminated in his favor on January 8, 2020. As a result of the assaults, the Plaintiff suffered from recurrent headaches and back pain. As a result of his false arrest and prosecution he also lost his home, the job he was about to start, and all his personal belongings.
