Bush, John Doe #1, John Doe #2, and John Does and, thereafter, was maliciously prosecuted by the Kings County District Attorney’s Office (KCDAO). In the course of their investigation of an alleged robbery, Defendants without lawful justification, intentionally, maliciously, and with deliberate indifference to or reckless disregard for the natural or probable consequences of their acts, (1) ignored problems concerning the credibility and reliability of the witnesses/victims of the robbery arising from inconsistencies in the witnesses initial and subsequent identifications of suspects, (2) violated NYPD guidelines (Defendant NYPD Officer Bolden, in particular) regarding the proper presentation of a photo array and the proper assembly of and conducting of a suspect lineup, (3) falsely swore  to the contents of a criminal complaint (Defendant NYPD Officer Bush) that was irreconcilably inconsistent with the testimony of the witnesses/victims of the robbery. Adding insult to injury, the KCDAO committed egregious Brandy violations and other prosecutorial misconduct during the year-long prosecution of Plaintiff Ronald Bozeman. As a result of such malfeasance by the NYPD and the KCDAO, Plaintiff’s wife, Plaintiff Doris Bozeman, lost the services, society, and consortium of her spouse, for a considerable period of time.","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nyed.343915/gov.uscourts.nyed.343915.5.0_1.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/6304132/bozeman-v-the-city-of-new-york/"},{"name":"Kennedy, Joseph vs City of New York, et al.","start_date":"2013-05-13","disposition_date":"2013-10-29","payout_amount":62500,"disposition":"Settlement","docket":"13CV02531","court":"U.S. District Court - Eastern District NY","officer_name":"Bush, William A.","summary":"On or about July 28, 2012, Plaintiff was walking lawfully near his home. Plaintiff did not possess a weapon or any amount of controlled substance. At that time and place, Plaintiff was attacked by an unknown assailant and shot in the leg. Thereafter, Plaintiff was transported to a hospital by an ambulance, where Plaintiff was treated for his injuries. Upon his release from the hospital, Plaintiff was placed under arrest by Defendant officers who handcuffed his arms tightly behind his back without probable cause or grounds. In connection with his arrest, Defendants filled out false and/or misleading police reports and forwarded them to prosecutors at a District Attorney’s Office. As a result of Defendants’ conduct, Plaintiff was charged with Criminal Possession of a Weapon in the Second Degree, Reckless Endangerment in the Second Degree, Criminal Possession of a Weapon in the Fourth Degree, Criminal Possession of a Controlled Substance in the Third Degree, and Criminal Possession of a Controlled Substance in the Seventh Degree. Thereafter, Defendants repeatedly gave false and misleading testimony regarding the facts and circumstances of Plaintiff’s arrest. Specifically, Defendants falsely, knowingly, and maliciously alleged that they viewed a video of Plaintiff shooting himself and that they discovered a controlled substance in Plaintiff’s pants later. Plaintiff spent approximately nine days in custody. All charges against Plaintiff were dismissed on December 5, 2012.","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nyed.342145/gov.uscourts.nyed.342145.1.0.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/13049509/kennedy-v-city-of-new-york/"},{"officer_name":"Bush, William A.","disposition":"Zero Disposition","start_date":"2012-02-16","disposition_date":"2013-04-16","court":"U.S. District Court - Eastern District NY","docket":"12CV00559","name":"Santiago, Eduardo A/k/a Santiago, Edward vs City of New York, et al.","payout_amount":0,"url":"https://www.courtlistener.com/docket/12957018/santiago-v-city-of-new-york/"}],"id":"CY5F","url":"https://www.50-a.org/officer/CY5F"}
