When the Plaintiff tried to leave the scene, the Defendant punched him in the throat and kicked him in the legs, causing him to break his wrist. The Defendant then proceeded to damage the Plaintiff's car. When the NYPD Defendant members arrived, they questioned the Plaintiff, who was unable to communicate properly in English (NYPD should have arrived with a Chinese translator). So they talked to a few women associated with the Defendant, and they falsely claimed that the Plaintiff had choked the Defendant. PO Byrnes muddles what they were told by the women, and make it seem like the Plaintiff was the aggressor. PO Byrnes proceeds to tell this story to her supervisor, Lt. Andino. PO Stein is the only officer to appear sympathetic with the Plaintiff, while PO Porzelt comically making fun of the Plaintiff. PO Barile's investigation of the scene relied solely on hearsay from the Lt., and did not consist of a single investigatory question to either parties. The Plaintiff tries to communicate with PO Barile, but is immediately shut down. The Plaintiff was charged and arrested without any questions asked to him, while Defendant Weng was released with a DAT. The entire time the Plaintiff was treated at the hospital, he was handcuffed. Despite his injuries, he was arraigned and held for 11 hours. He was indicted on November 21, 2013, based on false testimony. Then, Detective Duane Atkinson, Sergeant Joseph Muller, PO Anthony Andino, and Sergeant Michael Billotto pulled Plaintiff over, falsely claiming that Plaintiff’s brake lights were inoperable. The officers asked for permission to search the vehicle. When Plaintiff said that they could not without a warrant, the officers asserted that they smelled marijuana, which Plaintiff denied. The officers then searched the vehicle for twenty minutes, during which they repeatedly went to and into their unmarked police vehicles. Afterwards, the officers asserted that they had discovered marijuana. Plaintiff told them there was no marijuana in the car and that anything they had was planted there; such a practice, called “flaking”, disproportionately affects African-Americans, including Plaintiff. Plaintiff was arrested without legal basis. He was searched again at the precinct. No illegal items or contraband were recovered. Despite this, Plaintiff was issued a Desk Appearance Ticket. Officers provided false information to the DA’s Office, and, upon information and belief, during the criminal proceedings they forwarded false evidence to the same office.
