More specifically, plaintiffs were asleep when approximately 15 officers in SWAT gear, while pointing guns, were breaking down their door. Plaintiffs were unlawfully searched and placed in excessively tight handcuffs.\n\nPlaintiffs remained cuffed in their own living room for about 1 hour, while the police officers searched their home, causing severe property damage, including\nto broken doors, broken furniture, broken glassware, and a busted water pipe that flooded the home. The officers also broke into one of the plaintiff's safe and confiscated approximately $1,000. \n\nPlaintiffs were eventually transferred to the 105th precinct, where one of the plaintiffs was questioned about a gun that was found in his house, which he explained to be a paintball gun. After 36 hours in unlawful custody, the plaintiffs were charged with crimes they did not commit. Nicholas Bekas and a John Doe officer falsely arrested John Sekeene in the MTA Jamaica Center/Parsons-Archer subway station in Queens County. When Skeene arrived on the platform, the J train was stationary, and Skeene and others began to board the train through an open door. Skeene and many others walked between the train cars in order to spread out through the stationary train as it was overcrowded. Bekas ordered Skeene off the train. Bekas demanded ID from Skeene, who produced a valid ID card. Bekas called over the unknown officer. Unknown PO called Skeene’s name over the radio to check for outstanding warrants, while Bekas ordered Skeene to hand over his backpack for inspection. Skeene complied and his bag was searched, the bag contained a laptop, camera, cell phone, and Playstation Portable.  Skeene informed the unknown officer he was on parole, at which point Bekas and the officer handcuffed and detained him, before taking him to a precinct. He walked to the Manhattan-bound \"E\" train platform. The train was sitting stationary on the platform with only one door open since it was the terminal stop. Plaintiff and scores of other passengers boarded the train through the one open door and\nwalked between the cars in order to spread throughout the stationary train. Holman ordered plaintiff to get off the train and come speak with him. Plaintiff complied and provided his identification. Holman indicated he was going to arrest plaintiff for walking between the cars. Plaintiff verbally protested. Holman ordered plaintiff to sit down on a nearby bench and grabbed his canister of pepperspray. Another officer, Bekas approached the scene. Holman jumped on plaintiff's back and yelled \"HE'S RESISTING!\" Plaintiff was tackled to the ground. Holman discharged a large amount of pepperspray directly into plaintiff's eyes, and Holman repeatedly drove his knee into plaintiff's back. Officers took plaintiff to a nearby police station. After spending a short time in the precinct, plaintiff was transported to Jamaica Hospital Center where they treated his injuries. He was then taken back to the precinct. Holman and Bekas forwarded false information about the incident to the prosecutor, causing the prosecutor to press various criminal charges. A grand jury refused to indict plaintiff.
