The NYPD officer defendants collectively handcuffed plaintiff too tightly, forcefully dragged him from his home, and threw him face first into a police vehicle. The NYPD officer defendants falsely claimed that plaintiff had burglarized the department. Plaintiff could not make bail, was indicted for burglary, public lewdness, and criminal trespass on June 1, 2018, and was incarcerated in an NYC DOC facility for five months. While incarcerated, plaintiff was attacked by other inmates. The Bronx District Attorney's office made an application to the court on October 16, 2018, to have plaintiff immediately released on his own recognizance, and then on October 25, 2018, provided plaintiff's attorney a written Brady/Giglio disclosure that a witness informed them plaintiff was a lawful resident of his apartment. The indictment was dismissed and sealed on the Bronx DA's office's motion on February 28, 2019.
