As Mr. Davis was walking along Washington Avenue, NYPD Officers Miret and Marcellus yelled at Mr. Davis as they drove by. After having been harassed by NYPD in the past and considering he was alone at 4:30 a.m., Mr. Davis ran away. Around 1075 Washington Avenue the Defendant Officers caught up with Mr. Davis and struck him with their vehicle. Mr. Davis was hit so hard, his sneaker came off and he lied on the ground in significant pain. Subsequently he was handcuffed by the Defendant officers and waited for an ambulance. Mr. Davis was transported to Lincoln Hospital and x-rayed before being taken to 42nd Precinct. Eventually Mr. Davis was taken to Central Booking in the Bronx where he first learned he was being charged with Criminal Possession of a Weapon. Mr. Davis spent ten days in Vernon C. Bain Correctional facility before he was released.
