The plaintiffs asked if the handcuffs could be loosened or removed but the NYPD officers ignore their requests. When the plaintiffs inquired why they were being arrested, the NYPD officers threatened them with bodily harm, pushed, shoved, cursed, and screamed at them. People in the crowd who were fearful approached the NYPD officers but were threatened with arrest and bodily harm. When one plaintiff, complained about the verbal and physical abuse they were immediately subjected to abuse including being forcibly grabbed, slammed down on the floor, punched, kicked, and yelled at. The plaintiffs were dragged and pushed into the NYPD police vehicles. While at the precinct, the NYPD officers conducted an unlawful search of the plaintiffs. The NYPD officers did not find any contraband during their search however, they continued to detain the plaintiffs. The plaintiffs were detained for a lengthy period of time until being transported to Central Booking to wait for arraignment. The prosecutors believed the reports and statements from the NYPD officers and initiated criminal actions against the plaintiffs. The plaintiffs were arraigned and released on their own recognizance. The handcuffs were also placed unreasonably tight, leading to pain and injury to her wrists and hands. Although she informed the officers of the discomfort and requested the handcuffs be loosened, they ignored her.\n\nSmith was taken to the 73rd Precinct, where she was searched, fingerprinted, and placed in a holding cell. After several hours, she was issued a summons for Disorderly Conduct and released. The officers allegedly provided false or incomplete information to the District Attorney’s Office, leading to Smith’s prosecution. Smith later sought medical attention for her injuries and was diagnosed with a torn tendon.
