Plaintiff Mitchell called 911 and PO Steven Nunezbourdierd and other POs responded. POs stopped the neighbor, who was attempting to flee with the weapon and blood on his clothes. Plaintiffs then explained the circumstances of the attack but POs failed to conduct a proper investigation and instead arrested Plaintiffs Mitchell and Nowell, affixing too-tight cuffs to their wrists. Plaintiffs Mitchell and Nowell requested that the handcuffs be loosened but POs ignored the request, resulting in significant discomfort and pain to Plaintiffs. Plaintiffs were publicly searched without legal justification and transported to the 42nd Precinct where they were held for approximately 15 hours before being taken to Central Booking, where they were kept for an additional 12 hours before being released. Plaintiff Delarosa was arrested at the hospital and remained shackled to his bed for approximately 8 days before he was taken to Central Booking. After 8 additional hours in unlawful custody Plaintiff Delarosa was finally released. Plaintiffs were maliciously prosecuted but all charges were ultimately dismissed.
