The defendant officers unlawfully searched a purse owned by the driver's girlfriend and found a firearm. The defendants recovered another firearm from the floorboard of the vehicle belonging to the driver. Without probable cause that the plaintiff was involved with any crime, he was still charged with criminal possession of both firearms and was detained in inhuman conditions during Covid. Plaintiff George was question regarding the whereabouts of his son then taken to a police van. POs refused to tell Plaintiff George where his wife was or her physical condition. Plaintiff George was taken to the 73rd Precinct where he was placed in a cell with 10 - 15 other individuals. Plaintiff Andrea was taken from the hospital to the 73rd Precinct where she was kept in a holding cell with a woman who appeared mentally ill, compelling Plaintiff Andrea to stand on her feet the entire time she remained in the holding cell. Plaintiffs were then transported together to Central Booking, where they were held until their release through a rear door around 2:00 a.m. on May 4, 2013. The District Attorney's Office declined to prosecute due to insufficient evidence. When Plaintiffs returned home they found their residence completely torn apart, requiring several weeks to clean and fix the damage. Despite this, he was taken to the 73rd Precinct, where defendant officer Cullen conveyed false information to prosecutors, leading to plaintiff's prosecution for possession of a loaded rifle and ammunition.  Plaintiff remained in police custody for approximately 24 hours before his arraignment, at which time the case was adjourned.  Defendant officer Cullen subsequently falsely swore to a supporting deposition, and plaintiff remained held in police custody.  In sum, he was held in custody for nine days before making bail.  Plaintiff had to appear for over a dozen court appearances. Nevertheless, they were transported in handcuffs to the 73rd precinct. Inside the precinct, R.G. was searched by a female officer and handcuffed to a bar in a back room. Mr. Newsome was also searched and then placed in a cell with several other individuals. Approximately twelve hours later, Mr. Newsome was released with a Desk Appearance Ticket and R.G. was permitted to leave with him. When they returned to their home they had to gain entry by climbing through a window because Police officers had placed a padlock on the front door and claimed to have lost the key. Mr. Newsome was required to make a court appearance and wait several months before he was informed that the Kings County District Attorneys' Office declined to prosecute. The defendant officers knowingly made false statements to the District Attorney's Office that the Plaintiff had committed the crime of selling alcohol to a minor in order to cause Plaintiff to be prosecuted. Not knowing that the whole incident was recorded, Plaintiff accepted a plea of guilty.
