When the light was green, Plaintiff drove straight, and defendants turned on their lights and sirens and pulled over Plaintiff. Two Defendants exited their car and approached Plaintiff's vehicle. Defendant on the driver's side asked Plaintiff what he was doing and where he was going. Plaintiff answered he was looking for parking and going home. Defendant asked Plaintiff if he was drinking that night. Plaintiff responded he did not drink anything with alcohol. Defendants ordered Plaintiff to step out of the car and show ID. Plaintiff complied, stepped out of the vehicle, and handed defendant his license. Defendants ordered Plaintiff to the rear of the vehicle, and ordered a breathalyzer test. Plaintiff complied with the order to the back of the vehicle, and agreed to the test. Plaintiff completed the test two or three times. The breathalyzer results showed plaintiffs blood alcohol content was 0.00%. Defendants handcuffed, arrested and transported plaintiff to the highway patrol precinct. Defendants ordered Plaintiff to complete a walking and coordination test. Plaintiff passed the test. Defendants ordered Plaintiff to take another breathalyzer test at the precinct. Results of each test showed Plaintiff had a blood alcohol content of 0.00%. Plaintiff was transported to the 30th precinct. Defendants wrote in their reports Plaintiff refused to take any of the six breathalyzer tests. Plaintiff's drivers license was suspended. Plaintiff was transported to Manhattan Central Booking. After 27 hours, Plaintiff was arraigned. Plaintiff returned to court on four occasions.
