She was standing in line to exit the bus when a woman behind her tried to push past her. Plaintiff said to the woman, “Miss, calm down. We’re all getting off the bus.” This woman, later identified as an unnamed NYPD officer who was not in uniform, yelled at plaintiff obscenities, calling her a b*tch and saying she was going to f*ck her up. After exiting the bus, the unnamed police officer attacked Plaintiff Preston and punched her several times in the face. Defendant Officer Crecca arrived on scene and saw the woman still attacking Plaintiff Preston; he attempted to separate the two and succeeded in restraining the woman. The woman admitted she had cut Plaintiff Preston on the bus. Plaintiff Preston attempted to continue traveling to work with injuries to her face and head; the woman, however, decided to announce that she wanted to press charges against Plaintiff Preston. Defendant Officer Crecca thus ordered Plaintiff to return to the scene, which she complied with, saying only she just wanted to go to work. Defendant Crecca told Plaintiff Preston that if the other woman did not want to press charges, they would be free to go; if she did, Plaintiff would be free to press charges. When other officers, unnamed, arrived on the scene, they handcuffed and arrested Plaintiff. The other woman was not arrested. \n\nPlaintiff Preston was taken to the precinct, searched, and detained. When Plaintiff Preston wanted to pursue charges against the woman, she was told by an unnamed police officer that it was too late. She was released and when she got home, Plaintiff Preston’s mother called an ambulance which took her to Queens General Hospital. She was treated for two black eyes and muscle pain in her face. In the call, her mother had mentioned a physical assault - offiers thus arrived at the hospital and told her to file a complaint. Plaintiff Preston thus returned to the precinct but when she tried to file charges, the officers told her that the courts had control and she could not file them. Plaintiff Preston was charged with third degree assault and second-degree harassment. She filed an IAB complaint about the incident on April 26, 2017. Before the charges were dismissed on July 28, 2017, Plaintiff received two mysterious phone calls from people who identified themselves as officers asking why Plaintiff Preston had filed an IAB complaint against an officer at the 103rd precinct.","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nyed.409193/gov.uscourts.nyed.409193.1.0.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/6379513/preston-v-city-of-new-york/"}],"id":"D589","url":"https://www.50-a.org/officer/D589"}
