Plaintiff maintains that the police fabricated false evidence and used it against plaintiff. On or about October 6, 2014, the Jury rendered a verdict of guilty in plaintiff's case. Plaintiff was sentenced to a term of imprisonment. On October 11, 2017 plaintiff's conviction was reversed.  A retrial commenced. On February 5, 2019, plaintiff was acquitted of all charges by Jury Verdict. On September 28, 2009, the officers coerced an alleged eye witness into viewing photos including plaintiff Donald Debrosse, despite the witness not having sufficient opportunity to view the shooter. On February 8, 2010, Debrosse was arrested without probably cause, and Det. Gaynor informed Debrosse's attorney that he would be placed in a lineup and refused to postpone this so that the attorney could be present. The defendants claim that the witness identified Debrosse in the lineup, but the witness did not actually do so because she did not see the shooter. \nDebrosse was charged with offenses including Attempted Murder in the Second Degree, which were submitted to the Grand Jury on February 11, 2010. Debrosse remained in custody for 3 weeks before making bail. On September 8, 2011, the court held a Wade hearing and concluded that the lineup procedure was defective, and that evidence should be suppressed. There was a history between the defendant officers and Debrosse due to his prior investigations and arrests, and the complaint alleges that the officers intended to punish Debrosse for his perceived involvement in criminal activity.
