This occurred while Plaintiff was lawfully present near a building located in Brooklyn, solely because he is a Black male. Subsequently Police officers moved Plaintiff to another area where they unlawfully detained him for approximately 3 hours. They falsely accused him of assault and illegally seized his person aggressively grabbing him about his head and body. Moreover they illegally searched his person and personal belongings without finding any contraband to indicate that he had committed a crime. Then Police Officers grabbed Plaintiff about his body and extremities before violently contorting his arms and wrists behind his. They tightly handcuffed him, causing him pain and discomfort. Despite Plaintiff’s complaints, the Police Officers did not loosen the handcuffs or provide an explanation for his arrest. Then Plaintiff was taken against his will first to various Precinct and then to the Central Booking. During this time he was illegally fingerprinted, photographed, searched or strip-searched, questioned about his background, illegally interrogated without presence of counsel or being read his Miranda rights. He remained illegally detained until January 18, 2021 when he was release from physical custody. Police Officers fabricated false evidence and information and on this basis they initiated a malicious prosecution against Plaintiff. They forwarded a criminal complaint to the District Attorney’s Office, in which they falsely affirmed that Plaintiff had violated a protective order. Eventually all the criminal charges against the Plaintiff were fully dismissed on July 26, 2021.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=37frt/9fG56KmBhXmAJVQw==","type":"complaint"}]},{"name":"Cruz, Rafael vs City of New York, et al.","start_date":"2017-04-07","disposition_date":"2018-12-11","payout_amount":22500,"disposition":"Settlement","docket":"022761/2017E","court":"Supreme Court - Bronx","officer_name":"Ruiz, Paolo","summary":"On or about March 18, 2014 at or around 9 am, Plaintiff was within his residence at Help USA Bronx Crotona Park North, 775 Crotona Park North Bronx in the Bronx county.
